These Terms of Service (the “Terms”) constitute a legally binding agreement between you and Elevate Medical Aesthetics PLLC (referred to as “the Company,” “we,” “our,” or “us”) governing your use of our informational website (https://www.elevatemedaesthetic.com), our online booking portals powered by our infrastructure partner, Boulevard (collectively, the “Platform”), and any clinical or retail services provided by us (collectively, the “Services”).
Your use of the Platform and Services constitutes your irrevocable acceptance of and agreement to all of the terms, conditions, and notices contained herein, alongside our Privacy Policy and our Cookie Policy. If you do not agree to these terms, you must immediately cease using our Platform.

1. OVERVIEW & SERVICES
Elevate Medical Aesthetics PLLC is a Texas-based medical aesthetics practice providing minimally invasive clinical treatments, medical-grade aesthetician options, and therapeutic skincare solutions. The Platform provides tools to allow users to evaluate treatments, securely coordinate appointment scheduling via Boulevard, buy retail products or electronic gift certificates, and enroll in recurring practice memberships.
Our digital frameworks are intended exclusively for individuals located within the United States. We make no claims that our Platform resources are lawful or accessible outside of the United States.
2. ELIGIBILITY & USER ACCOUNTS
2.1 Age and Representation
You must be eighteen (18) years of age or older to independently access our Platform or arrange appointments for our clinical Services. By interfacing with our Platform, you represent and warrant that you are at least 18 years old.
2.2 Account Security
To request clinical appointments, buy packages, or access patient information portals, you may be required to register a profile managed through our engineering partner, Boulevard. You are completely responsible for maintaining the confidentiality of your account password and access keys. You accept full liability for all actions, bookings, card additions, and notifications occurring under your profile. You agree to alert us immediately if you suspect a security breach or unauthorized log-in.
3. APPOINTMENT BOOKING & NO-SHOW/CANCELLATION POLICY
3.1 Credit Card Authorization
Scheduling an appointment via our online booking engine requires a valid credit or debit card to be stored securely on file. You do not pay for your medical or aesthetic treatments in advance. Your payment for clinical services will be collected and processed inside our office upon the physical completion of your treatment.
3.2 Cancellation and No-Show Fees
By securing an appointment slot on our calendar, you explicitly authorize Elevate Medical Aesthetics PLLC to securely store your credit card token within our Level 1 PCI-compliant Boulevard vault.
To respect the time of our practitioners and patients on our waiting list, we enforce a strict 24-hour cancellation window:
Late Cancellation Fee: If you cancel, change, or reschedule an appointment less than twenty-four (24) hours before its scheduled start time, your stored card on file will be automatically charged a late cancellation penalty fee of $50.00.
No-Show Fee: If you fail to attend a scheduled appointment entirely without providing any prior notice, your stored card on file will be automatically charged a no-show penalty fee of $75.00.
All late fees and no-show penalties are final, non-refundable, and will be charged to the card stored in your Boulevard profile.
4. IN-OFFICE RETAIL AND SKINCARE PRODUCT SALES
We display, offer, and sell medical-grade skincare formulations and select physical home-care items directly within our office location.
Clinical Control Disclaimer: Medical-grade skincare products contain active ingredients that may require explicit provider supervision. We heavily advise a formal skin evaluation prior to application.
Returns & Exchanges: Due to the clinical and sanitary nature of medical-grade skincare products, all physical retail sales handled inside our office are final. Exchanges or credits may only be issued at the sole discretion of our clinical staff in cases of verified manufacturer damage or documented adverse allergic reactions evaluated by our practitioners.
5. THIRD-PARTY AFFILIATE LINKS (SKINBETTER SCIENCE)
Our website features dedicated redirect linkages to the official SkinBetter Science online store to allow clients to buy items digitally for home delivery.
Independent Third-Party Ownership: You explicitly acknowledge that Elevate Medical Aesthetics PLLC does not own, operate, manage, or control the SkinBetter Science digital storefront, its payment processing systems, or its logistical shipping infrastructures.
Liability Waiver: Any purchase executed through the external SkinBetter Science link is a transaction completed directly between you and SkinBetter Science. We assume zero responsibility or liability for shipping delays, missing parcels, credit card errors, order inaccuracies, or data breaches occurring on external domains. Your purchases on that platform are governed exclusively by SkinBetter Science’s independent terms of service and privacy policies.
6. THIRD-PARTY FINANCING PARTNERS (CARECREDIT & CHERRY)
To increase patient accessibility to our options, our Platform contains external portal workflows and application hyperlinks hosted by independent consumer installment loan and patient financing companies, specifically CareCredit (Synchrony Bank) and Cherry (Cherry Technologies, Inc.).
Independent Underwriting: Elevate Medical Aesthetics PLLC is entirely independent of these lending networks. We do not act as an underwriter, we do not make loan approvals, we do not evaluate credit lines, and we do not establish dynamic financing interest rates.
Separate Financial Contracts: Applying for a loan or financing program via a provided link establishes a direct financial contract exclusively between you and CareCredit or Cherry. We assume zero corporate liability for missed payments, soft or hard credit score updates, calculated interest accruals, card issuance complications, or third-party debt collection activities resulting from your lines of credit.
Service Fee Adjustments: Treatment or package prices financed through third-party platforms are subject to any active operational guidelines established at our physical check-out counter at the time of processing.
7. ONLINE GIFT CARDS & MEMBERSHIP SUBSCRIPTIONS
7.1 Electronic Gift Cards
Digital gift cards purchased via our online Platform are valid exclusively for treatments or in-office retail items distributed by Elevate Medical Aesthetics PLLC. Gift cards cannot be redeemed for physical cash, cannot be transferred for external market value, and cannot be applied to online purchases hosted on outside vendor sites (such as the third-party SkinBetter Science portal).
7.2 Membership Programs & Automated Billing
If you elect to enroll in an online membership subscription option offered through our Platform, your enrollment establishes a continuous, recurring payment schedule managed via the Boulevard Billing Network.
Automatic Deduction Authorization: By signing up, you explicitly authorize us to charge your stored payment card on a repeating monthly or designated periodic cycle for the specific subscription tier rate selected.
Cancellation of Membership: Terms governing minimum membership durations, rollout perks, rollover treatment credits, and advance notifications required for termination are detailed dynamically during membership sign-up and are fully integrated into these Terms.
8. CLINICAL DISCLAIMERS & EMERGENCY LIMITATIONS
8.1 Emergency Warning
OUR SERVICES AND PLATFORM DO NOT CONSTITUTE EMERGENCY MEDICAL INFRASTRUCTURE. IF YOU ARE EXPERIENCING A SEVERE REACTION, AN ACUTE MEDICAL ANOMALY, OR A HEALTH EMERGENCY, YOU MUST IMMEDIATELY DIAL 9-1-1 OR PROCEED TO THE NEAREST EMERGENCY ROOM.
8.2 Patient Disclosure Obligations
Aesthetic injectables (such as neurotoxins or dermal fillers) and advanced aesthetician treatments (such as chemical peels, microneedling, or laser therapies) carry inherent clinical contraindications. Every client is required to provide complete, truthful, and accurate medical backgrounds, allergy listings, medication declarations, and pregnancy/nursing updates during intake workflows. We reserve the absolute right to refuse clinical service if a procedure presents an unmanageable health risk.
9. INTELLECTUAL PROPERTY & LIMITATIONS ON USE
All structural graphics, code, visual designs, slogans, copy, trade dress, and brand elements displayed across elevatemedaesthetic.com represent the exclusive intellectual property of Elevate Medical Aesthetics PLLC or our platform providers.
You are granted a strictly limited, revocable, non-exclusive license to view our web text for individual, non-commercial purposes. You are strictly prohibited from scraping data, mirroring site files, executing automated bots on our booking portals, or copying our media elements for alternative commercial operations without explicit written permission.
10. INDEMNIFICATION
You agree to defend, indemnify, and hold completely harmless Elevate Medical Aesthetics PLLC, its officers, directors, practitioners, staff, suppliers, and legal entities from and against any third-party claims, liabilities, losses, judgments, damages, and costs (including reasonable legal fees) arising from your misuse of our Platform, your violation of these Terms, your failure to disclose accurate medical histories during intake reviews, or actions carried out via your online booking profile.
11. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable United States and Texas state laws, Elevate Medical Aesthetics PLLC and its platform software vendors shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of data, loss of business revenue, personal injury, skin reactions, or property damage tied to your use of our Platform, your application of retail products, or your reliance on info published on our domains.
12. APPLICABLE LAW & JURISDICTION
These Terms, our digital properties, and any operational disputes arising out of your relationship with Elevate Medical Aesthetics PLLC shall be governed by, interpreted under, and construed in total accordance with the laws of the State of Texas, without giving effect to any rules of conflict of laws.
Any formal legal action or judicial proceeding directly or indirectly relating to these terms shall be filed exclusively in the state or federal courts located in Brazoria County, Texas (or the nearest surrounding judicial seat holding jurisdiction over Pearland, Texas). You hereby irrevocably submit to the personal venue of these regional courts.
13. TERMINATION OF ACCOUNTS
We reserve the absolute right, without prior warning, without liability, and at our sole discretion, to terminate or restrict your access to our online Platform, block your booking system profile, or cancel pending calendar holds if we verify or suspect:
A material breach of any provision listed within these Terms.
Fraudulent, deceptive, or malicious activity involving payments or reservations.
Harassing, abusive, threatening, or harmful behavior directed at our clinical providers or administrative staff.
